These Terms of Service (“Terms”) constitute a legally binding agreement between you and Luxury Hotels Group Ltd (“Luxury Hotels Group”, “we”, “us”, or “our”), a company registered in England & Wales. Please read these Terms carefully before accessing or using our platform at luxuryhotels.group (the “Platform”).
1. Acceptance of Terms
By accessing or using the Platform in any manner — whether as a registered user, a guest browser, or an API integrator — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease your use of the Platform. Your continued use following any update to these Terms constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and possess the full legal capacity to enter into binding contracts under the laws of your jurisdiction in order to use the Platform or submit listings. By using the Platform, you represent and warrant that you meet these requirements and that all registration information you provide is accurate, current, and complete. We reserve the right to suspend or terminate accounts where we have reasonable grounds to believe eligibility requirements have not been met.
3. The Platform
Luxury Hotels Group operates a curated online marketplace connecting luxury property owners, hotel operators, and estate agents with an audience of high-net-worth and ultra-high-net-worth individuals across 89 countries. We are a marketplace intermediary, not a real estate agent, hotel booking agent, or financial adviser; we do not act on behalf of either buyers or sellers in any transaction.
We do not guarantee the completion of any transaction, the accuracy of third-party content, or the suitability of any listing for any particular purpose. Any transaction entered into between a buyer and a seller as a result of an introduction made through the Platform is solely between those parties. We strongly recommend that all users take independent legal and financial advice before entering into any property transaction.
4. User Accounts
Certain features of the Platform require registration. You agree to provide accurate, complete, and up-to-date information during the registration process and to update that information promptly if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at info@luxuryhotels.group if you become aware of any unauthorised use of your account or any other breach of security. We shall not be liable for any loss arising from your failure to comply with this obligation. We reserve the right to disable any account at our sole discretion if, in our opinion, you have failed to comply with these Terms.
5. Listing Submissions
When you submit a property or hotel listing, you represent and warrant that: (a) the information provided is accurate, complete, and not misleading; (b) you have the full legal right to advertise the property or hotel in question; and (c) the listing does not infringe any third-party intellectual property rights or violate any applicable law or regulation.
We reserve the right, at our sole discretion and without prior notice, to review, edit, decline, or remove any listing that we determine, acting reasonably, does not meet our quality standards, violates these Terms, or is otherwise inappropriate for the Platform. No refund shall be due in respect of a subscription fee paid where a listing is removed due to a breach of these Terms by you.
6. Subscription & Payments
Access to certain listing tiers and features requires payment of a subscription fee. All fees are quoted exclusive of VAT where applicable and are due in advance for the subscription period selected. We accept payment via the methods displayed at checkout, which are processed by our third-party payment provider.
Unless cancelled at least 48 hours before the end of the current subscription period, subscriptions will automatically renew for a further period of the same duration at the then-current rate. All fees paid are non-refundable except where required by applicable consumer protection law. We reserve the right to modify subscription pricing upon 30 days’ written notice, and continued use of the Platform following such notice constitutes your acceptance of the revised fees.
7. Intellectual Property
All intellectual property rights in the Platform and its content — including, without limitation, the Luxury Hotels Group name, logos, design, editorial content, software, and databases — are owned by or licensed to us. Nothing in these Terms grants you any right to use our intellectual property other than as expressly permitted herein.
By submitting content to the Platform (including listing descriptions, images, and other materials), you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content on the Platform and in our promotional materials for the purposes of operating the service. You retain ownership of your content and may request its removal by contacting us, subject to any legal retention obligations.
8. Prohibited Conduct
You agree not to use the Platform to: (a) submit fraudulent, misleading, or inaccurate listings; (b) impersonate any person or entity, or misrepresent your affiliation with any person or entity; (c) scrape, crawl, or systematically extract data from the Platform by automated means without our prior written consent; (d) transmit any unsolicited commercial communications to other users; or (e) engage in any activity that interferes with or disrupts the operation of the Platform.
You further agree not to circumvent any technical measures we employ to protect the Platform, attempt to gain unauthorised access to any part of the Platform or its related systems, or use the Platform for any unlawful purpose including, without limitation, money laundering, fraud, or the marketing of properties in violation of applicable sanctions. We reserve the right to report any suspected unlawful activity to the relevant authorities.
9. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all implied warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components, nor do we make any warranty as to the accuracy, completeness, or reliability of any content accessible through the Platform. We do not guarantee that any enquiry submitted through the Platform will result in the completion of a transaction or the achievement of any commercial outcome.
10. Limitation of Liability
To the fullest extent permitted by applicable law, our total aggregate liability to you in connection with these Terms or your use of the Platform — whether in contract, tort (including negligence), or otherwise — shall not exceed the total subscription fees actually paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or loss of business opportunity, even if we have been advised of the possibility of such damages. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
11. Privacy
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your personal data as described in the Privacy Policy, which sets out how we process your data in compliance with the UK General Data Protection Regulation (“UK GDPR”) and, where applicable, the EU General Data Protection Regulation (“EU GDPR”).
12. Governing Law & Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except that nothing in this clause shall prevent us from applying to any court for injunctive or other equitable relief where necessary to protect our legitimate interests.
13. Changes to These Terms
We reserve the right to amend these Terms at any time. Where we make material changes, we will provide at least 30 days’ notice by posting a notice on the Platform and, where you have provided us with an email address, by sending you an email notification. For non-material changes (such as typographical corrections), we may update the Terms immediately without prior notice. We encourage you to review these Terms periodically. Your continued use of the Platform after the effective date of any change constitutes your binding acceptance of the revised Terms.
